SwimPro Network is a trade community built by a pool professional for pool professionals — manufacturers, distributors, builders, service techs, and the rest of the water trade. It exists to help people in the trade talk, work, and run their shops. The people on it manage what they post and what they put in. SwimPro does not stand behind, fact-check, or take responsibility for user content or user-entered data.
These Terms of Use (“Terms”) are a binding agreement between you and the operator of SwimPro Network (“SwimPro,” “we,” “us”). By creating an account, checking the box that you agree, signing in, or using the site, app, Shop tools, Live, messages, jobs, or any related service (together, the “Service”), you agree to these Terms.
If you do not agree, do not use SwimPro. If you use SwimPro on behalf of a company, you confirm you have authority to bind that company, and “you” includes that company.
These Terms are meant to be complete and specific. If a section is not listed here, we are not promising it.
SwimPro is a privately operated online network for the swimming-pool trade. It was created by a pool professional to help people in the trade — not as a government service, not as a homeowners’ forum, and not as a licensed professional advisor.
SwimPro is a platform and a set of tools. Users create and manage the posts, comments, photos, live streams, messages, job listings, promotions, quotes, invoices, customer records, routes, inventory, chemistry numbers, and every other piece of information on the Service. We host the Service. We are not the author, publisher, or speaker of what users post, and we are not the owner or keeper of the business records you type in.
Nothing on SwimPro is legal, tax, engineering, medical, or licensed contracting advice. Water chemistry calculators, quote templates, and books tools are conveniences only. You remain responsible for your licenses, permits, insurance, testing, manufacturers’ instructions, and the work you do in the field.
You must be at least 18 years old.
SwimPro is only for people and companies in the swimming-pool trade: pool professionals (service, build, retail, design, and related field work), manufacturers, and distributors. Homeowners, the general public, and anyone we cannot verify as trade are not permitted.
You must sign up with your real name (or the name you work under) and the company you work for. Company name is required.
Trade-only is an access rule, not a speech rule. Accounts that are not trade, or that cannot be verified as trade, may be removed so the network stays professional. That is not moderation of opinions. It is who the Service is for.
You are responsible for your login, your devices, and everything done on your account. Keep your password to yourself. Tell us at the contact below if you think someone else is in your account.
You may delete your own account at any time from Edit profile. Deleting your account removes your profile, shop books, messages, jobs, and sign-in, and takes down posts you made, as described in the product. That is a request from you, and we honor it.
We may close an account that is not trade, that was created under false company information, or that is used to commit violence or a crime as defined in these Terms. We do not close accounts because we dislike a post, a price, a chemical take, or a competitor.
“User Content” means everything you or any other user submit, post, stream, upload, import, type, or otherwise put on SwimPro, including posts, comments, photos, files, live video and audio, messages, meeting details, job listings, promotions, ads, profile information, and all Shop data (customers, invoices, quotes, inventory, routes, water tests, equipment, notes, and imports).
You retain whatever rights you have in your User Content. You grant SwimPro a limited license to host, store, display, transmit, and back up that content only as needed to operate the Service you chose to use (for example, showing your post in the feed, your live to people who watch, or your invoice in your shop). We do not claim ownership of your posts or your books.
You, and only you, are responsible for your User Content. That includes whether it is accurate, lawful, defamatory, confidential, owned by you, or safe to share. SwimPro does not review User Content before it goes up, does not endorse it, and does not stand behind it.
You confirm that you have the right to post what you post, that you have the right to enter any customer, employee, or vendor information you put in Shop or elsewhere, and that your content does not infringe someone else’s rights.
SwimPro is not responsible for anything people post. We are not responsible for any data users input. That is the core of this Service.
Without limiting that sentence, we are not responsible for: opinions, arguments, prices, specs, chemical advice, salt-cell calls, plaster takes, job offers, wage claims, promotions, ads, live streams, messages, meeting notes, quotes, invoices, inventory counts, customer names and addresses, phone numbers, gate codes, photos of job sites, imported CSVs, or any other User Content.
If you rely on something another user said or typed — a dose, a part number, a “this will pass inspection,” a job lead, a quote, a live clinic — you do that at your own risk. Verify it yourself. SwimPro is not a party to any deal, hire, sale, warranty, or contract between users.
Shop tools store business records you enter. You are the business that collected that information. You decide what to put in. You must have permission to store customer and vendor information. We host it for your use of the Service. We are not your office manager, bookkeeper, chemist, or records custodian, and we are not liable if that information is wrong, incomplete, lost, or used by you in a way that breaks the law or a customer’s privacy.
To the extent a law such as 47 U.S.C. § 230 applies, SwimPro is an interactive computer service, not the publisher or speaker of User Content. These Terms do not make us an editor of the community.
SwimPro is a free-speech platform for the trade. Users manage the conversation. We do not take content down because it is rude, unpopular, wrong about chemistry, hard on a brand, a competitor complaint, a political take, or because someone is offended. We do not run a “hate speech,” “misinformation,” or “be nice” filter. Shop talk, disagreement, and hard opinions stay up.
Admin removes or disables content, or closes an account, only in the cases listed in this section. There is no hidden list.
A. By request. We will remove content or an account when the person who posted it, or the account holder, asks us to — including when you use Delete account. If you want your own post, live, or listing taken down, ask. That is your content.
B. Violence. We will remove content, and may close the account, when it is violence: a true threat of violence against a person, incitement of imminent violent crime, or content that is itself a violent crime against people (including coordinating an assault). Jokes about a pump that “killed” a pad, rough trade language, and arguments are not violence. A threat to hurt someone is.
C. Only what United States law requires a host to act on. These are legal duties, not speech rules we invented, and we do not stretch them into general moderation: (1) child sexual exploitation material, which we will remove and report as required by federal law; (2) a valid court order or other compulsory legal process directed at specific content or an account; (3) a valid copyright takedown notice under the Digital Millennium Copyright Act (17 U.S.C. § 512). We are not using copyright or “illegal” as a spare handle to pull down opinions.
If something is not in A, B, or C, admin will not delete it for viewpoint, accuracy, tone, or commercial rivalry. If the law later requires a host to act on a specific item, we will do the minimum the law requires and no more.
Reporting: you may email the contact below to request removal of your own content, to flag violence, or to send a copyright notice. We do not promise to referee disputes between users.
Shop (routes, customers, invoices, quotes, inventory, imports, books export) is a tool for pool companies. You enter the data. You are responsible for it. Results, totals, and inventory counts are only as good as what you put in. They are not audited financial statements and not a substitute for an accountant.
The water chemistry / LSI calculator is an estimate from numbers you type. It is not a lab, not a guarantee of plaster or equipment life, and not a replacement for a test kit, manufacturer limits, or a licensed professional’s judgment. If you dose a pool from it, that is your decision.
Quotes and invoices you generate are your documents. You choose the numbers, tax, terms, and whether a customer should sign them. SwimPro is not a party to the job.
Live streams are User Content. The host is responsible for what is shown and said. Watchers understand they are watching another user, not SwimPro.
Job listings are User Content from the poster. SwimPro is not the employer, recruiter, or background-check service.
Promotions and paid ads are User Content from the advertiser. Fees for Live (for manufacturers and distributors) and featured ads are for placement and hosting, not for our endorsement of the product or claim. Optional paid features are provided as-is. Unless a separate written receipt says otherwise, fees are for the listing period you bought and are not refunded because you did not like a comment thread. A vendor or distributor promotion may be checked only to confirm it is a trade offer from a manufacturer or distributor — eligibility, not a speech filter on the feed. Ordinary posts are not pre-reviewed.
The SwimPro name, look, software, and original materials we publish (not User Content) belong to us or our licensors. You may not copy the Service, scrape it for a competing network, or reverse engineer it except as the law allows.
Copyright complaints about User Content must be sent to the contact below with: your signature, the work claimed, the exact URL or location of the material, your contact information, a statement of good-faith belief, and a statement under penalty of perjury that you are the owner or authorized to act. That is the DMCA process. We are not a general “take this down because I don’t like it” desk.
Account data (name, email, company, city, role) is used to run your login, show your profile to the trade, and operate the Service.
Shop and customer data is yours. We store it so you can use Shop. We do not sell your customer lists. We do not use your invoices to market to homeowners. You must not put data in SwimPro that you have no right to store (including another shop’s books, or a customer’s information you are not allowed to keep).
Messages, meetings, and lives are between users. Treat them as you would any job-site conversation: if you would not want it on a truck radio, think before you post it.
The Service may be unavailable, and data may be lost, despite backups. Export your books if you need your own copy. Deleting your account deletes the shop data on that account as described in the product. We are not liable for data you chose not to export.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure; that chemistry, quotes, or inventory will be correct; that User Content is true; or that any job, part, or method you saw here will work in the field.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIMPRO AND ITS OPERATOR, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST WORK, LOST DATA, LOST CUSTOMERS, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF THE SERVICE, USER CONTENT, OR USER-ENTERED DATA, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID SWIMPRO FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). IF YOU ONLY USE FREE FEATURES, THAT AMOUNT IS US$100.
These limits are a fundamental part of the bargain. The Service would not be offered on these terms without them. Some places do not allow certain limits; in those places, our liability is limited to the fullest extent the law allows.
You will defend, indemnify, and hold harmless SwimPro and its operator from any claim, loss, damage, or expense (including reasonable attorneys’ fees) arising out of: your User Content; data you input (including customer and invoice data); your live streams; your ads or promotions; your use of Shop, chemistry, quotes, or jobs; your violation of these Terms or the law; or your dispute with another user, customer, vendor, or employee.
We may take over the defense of a claim with counsel we choose. You will cooperate. You will not settle a claim that admits fault by us without our written consent.
We may update these Terms. The effective date at the top will change. Continued use after an update is acceptance of the new Terms. If you do not agree, delete your account and stop using the Service.
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-law rules, and (where applicable) United States federal law, including 47 U.S.C. § 230 and the DMCA. You agree that the state and federal courts located in Virginia have exclusive jurisdiction, except that we may seek injunctive relief anywhere to protect the Service.
If a court finds a part of these Terms unenforceable, the rest stays in force. These Terms are the entire agreement about the Service. They supersede prior understandings about the Service. Failure to enforce a part is not a waiver.
